JUDGE REMANDS FDCPA CASE BACK TO STATE COURT

  • A Magistrate Court judge in New York has ruled that a defendant in a Fair Debt Collection Practices Act case failed to show that the plaintiff suffered a concrete injury after removing the case to federal court, and has remanded the case back to state court where it was originally filed.

  • The Consumer Financial Protection Bureau has denied a petition from a regional payday lending company that sought to set aside a Civil Investigative Demand, ruling that its request was not overly broad and does not impose an undue burden, while also claiming the company failed to “meaningfully engage” in the meet-and-confer process because it was not negotiating in good faith.

PLAINTIFFS IN SEVEN CLASS ACTIONS AGAINST BREACHED AGENCY SEEK TO CONSOLIDATE CASES

  • Consumers in seven different class actions filed against a collection agency that suffered a data breach have filed a motion to consolidate their lawsuits into one, which would put eight different law firms in charge of representing the plaintiffs.
