- The accounts receivable management industry lost a friend and a brother last week with the passing of Eric Foulk. Foulk, who most recently worked at TransUnion, had spent most of his career in the ARM industry, after he left the military. More details about Eric’s passing are available here. Judge Denies Competing Summary Judgment Motions in Case Over Whether Consumer Disputed Debt
- A District Court judge in Florida has denied competing motions for summary judgment in a Fair Debt Collection Practices Act case, in a case that hinges on whether a consumer saying, “Okay. All right. Well, thank you for your assistance then. That’s all I really needed for now. I’ll go ahead and conduct further inquiries about this matter independently” counts as a dispute of the debt after being prompted with the opportunity to dispute the debt by a representative of the defendant.

Teachers’ Union Sues MOHELA For Allegedly Mismanaging Student Loan Collections
- The American Federation of Teachers (AFT) has filed a lawsuit against the Higher Education Loan Authority of the State of Missouri (MOHELA), accusing the loan servicer of widespread mismanagement and failure to fulfill its responsibilities to student loan borrowers. The lawsuit, filed in the Superior Court of the District of Columbia, alleges that MOHELA’s actions have harmed millions of borrowers, particularly those in public service seeking loan forgiveness under the Public Service Loan Forgiveness (PSLF) program.
