FEDERAL GOV’T INSTRUCTS AGENCIES TO REMOVE MEDICAL DEBT FROM LOAN UNDERWRITING FACTORS
- Government agencies that make decisions about lending or guaranteeing loans must remove medical debt from their underwriting criteria, according to a memo issued yesterday by the White House Office of Management & Budget.
- The government said this is the next step because what has been done so far has not gone far enough.
APPEALS COURT RULES GOV’T LIABLE FOR FCRA VIOLATIONS
- Widening an existing split at the appellate level, the Third Circuit has ruled that the federal government can not claim sovereign immunity when sued for certain violations of the Fair Credit Reporting Act.
- The ruling overturned a motion to dismiss that had been granted by a District Court judge.
CFPB ANNOUNCES NURSING HOME DEBT COLLECTION HEARING, ANALYZES CONNECTION BETWEEN FINANCIAL ASSISTANCE AND MEDICAL DEBT
- The hearing will be held virtually September 8 and will feature Rohit Chopra and others exploring the “challenges” of nursing home debt collection practices.
- The policies put in place under the Affordable Care Act have not stopped individuals with low incomes from incurring medical debt, and even policy changes announced by the credit reporting agencies will likely not keep many medical debts from appearing on low-income consumers’ credit reports.
COLLECTOR ACCUSED OF VIOLATING FCRA, FCRA, REG F WHEN ATTEMPTING TO COLLECT ON UNPAID APARTMENT DEBT
- The complaint, all 47 pages of it, goes into great detail recounting conversations between the plaintiff and representatives of the defendant, and even accuses one representative of “gaslighting” the plaintiff.
- The complaint also accuses the collector of debt parking, a violation of Regulation F.
