APPEALS COURT RULES AGAINST FEDERAL GOVERNMENT IN FDCPA CASE
- There are limits to what the Fair Debt Collection Practices Act can be used for, and even the federal government is not immune to learning those lessons. The Court of Appeals for the Second Circuit on Thursday overturned a District Court ruling and reversed a three-decade precedent saying that the government can not use the FDCPA to collect back wages owed to an individual by her employer who was working in the U.S. on an H-1B visa.
JUDGE GRANTS MSJ FOR DEFENSE IN FDCPA CASE OVER ALLEGED MISREPORTED DEBT
- A District Court judge in Virginia has granted a defendant’s motion for summary judgment after it was accused of violating the Fair Debt Collection Practices Act by allegedly inaccurately reporting the amount of a debt to the bureaus, ruling that the plaintiff’s omission of all but one page of his credit report in his complaint painted a fuller picture of the situation that made it clear that the defendant did not misreport the amount that was owed.
REPORT BREAKS DOWN THE ‘HIDDEN COSTS’ OF CREDIT SCORING APPS
- Anyone in the accounts receivable management industry who credit reports cringes when the words “Credit Karma” are mentioned. The app has led to a significant spike in the number of disputes filed by consumers about items on their credit reports and caused companies in the industry to spend more time and resources investigating those disputes. Well, the benefits of using apps like Credit Karma may not be all they are thought to be, according to an analysis conducted by Consumer Reports, which wrote that five such credit monitoring services have “significant drawbacks and few upsides.”

- A new anti-robocall deadline went into effect last week and the Federal Communications Commission issued a Further Notice of Proposed Rulemaking to take additional steps to block robocalls from being connected with consumers as the fight against robocalls continued.
