UTAH JUDGE GRANTS MTD IN FDCPA CASE OVER LACK OF LICENSE
- A District Court judge in Utah has granted a defendant’s motion to dismiss a Fair Debt Collection Practices Act class action case, ruling that it did not need a license to collect in that state in order to file collection lawsuits against the two named plaintiffs. The judge ruled that the Petition Clause of the First Amendment, which affords individuals the right to petition the government for redress of grievances, preempted the defendant’s need for a license to collect in the state.

- Profits at PRA Group were down slightly in the second quarter of 2021, compared with the second quarter of last year, but the company is still riding high from its strong first-quarter results, the company announced on Thursday. As well, during a call with financial analysts, the Chief Executive of the company reiterated a series of five “strategic objectives” that the company has developed to guide its future, which others in the industry may want to use as a blueprint.
