Suit Accuses Collector of Sending Texts, MVN After Receiving Cease Request
- Off the bat, based on the complaint, this seems to be one of those cases that is definitely neither black nor white, and given the topic for today’s webinar, it seems incredibly appropriate. A collection operation is being accused of violating Regulation F and the Fair Debt Collection Practices Act because it appeared to attempt to collect different healthcare debts via text message and send a Model Validation Notice after the plaintiff requested communications to cease.

Court Dismisses FDCPA Case, Rules Plaintiff Lacked Standing
- A District Court judge in New York has dismissed a Fair Debt Collection Practices Act case and denied a motion to remand the case back to state court, ruling the plaintiff lacked standing after receiving an email from the defendant the day after the plaintiff refused to pay the debt.

Judge Questions Whether Administration is Trying to ‘Starve’ CFPB
- A federal judge has temporarily blocked mass layoffs at the Consumer Financial Protection Bureau as she evaluates claims about the Trump administration’s efforts to dismantle the agency. Judge Amy Berman Jackson’s decision came after contradictory statements from CFPB officials and the Justice Department about whether the agency was continuing to perform its mandatory functions, such as handling consumer complaints and overseeing financial institutions.

FTC Sues Perpetrators of Phantom Collection Scheme
- Don’t look now, but there was an enforcement action involving a debt collection company announced by a federal regulator. The Federal Trade Commission has obtained an injunction that halts the operations and freezes the assets of a pair of defendants — Ryan and Mitchell Evans — which operated a multitude of companies, including Blackrock Services, Blackstone Legal Group, Capital Legal Services, Quest Legal Group, Viking Legal Services, and others.
