Collector Accused of Not Including Mini-Miranda in Voicemails
- We generally don’t see a lot of Fair Debt Collection Practices Act lawsuits alleging violations of Section 1692e(11), so in and of itself, this complaint is a little unique in a sea of copycat complaints that are filed daily. In this case, the plaintiff alleges the defendant left a number of voicemail messages without ever disclosing that the calls were an attempt to collect a debt and that any information would be used for that purpose.

90% of CFPB’s 1,700 Employees Laid Off
- The ongoing battle over the future of the Consumer Financial Protection Bureau has escalated once again, with the Trump administration pushing forward with mass layoffs of the agency’s workforce. In a move that significantly reduces the agency’s capacity to perform its statutory duties, approximately 1,500 out of the CFPB’s 1,700 employees received reduction-in-force (RIF) notices Thursday afternoon. A hearing has been scheduled for this morning by the federal judge presiding over a lawsuit filed by the union representing CFPB employees to discuss this latest development and whether it violates an injunction that has been put in place.

N.J. Appeals Court Upholds Ruling Denying Motion to Vacate Default Judgment
- A New Jersey Appeals Court has affirmed a lower court’s ruling denying an individual’s motion to vacate a default judgment obtained in a collection lawsuit, agreeing that the individual chose to wait too long to file the motion to vacate.

Bill Introduced to Expand Types of Debt Factored into Credit Scores
- A bill has been introduced in the Senate by the chairman of the Senate Banking Committee that would expand the types of bills and debts that credit reporting agencies would use to determine consumers’ credit scores, with the objective of helping individuals considered to be “credit invisible.”
