A California Appeals Court has overturned a lower court’s dismissal of a Fair Debt Collection Practices Act case, ruling that even a mistaken attempt to collect a debt from the wrong person can be subject to liability. The background: This case began when the plaintiff filed a collection lawsuit against the defendant. The defendant, upon receiving the complaint, filed a cross-complaint alleging identity theft, arguing that the debt collection action was directed at her in error.

Inflation may be cooling, but when it comes to credit card debt more than a third of cardholders are finding themselves in hot water. Roughly 2 in 5 credit cardholders, or 37%, have either maxed out a credit card or come close to doing so since the Federal Reserve began hiking interest rates in March 2022, according to a new online survey of 3,576 U.S. adults by personal finance firm Bankrate.

The Consumer Financial Protection Bureau yesterday announced an enforcement action against Apple and Goldman Sachs for mishandling consumer disputes and misleading users of the Apple Card. The financial penalties include a $45 million civil money penalty for Goldman Sachs, a $25 million penalty for Apple, and at least $19.8 million in redress to consumers.
