JUDGE GRANTS MSJ FOR DEFENDANT IN FDCPA CLASS-ACTION OVER 1099C LANGUAGE IN LETTER
- In a case that was defended by Rick Perr of Kaufman Dolowich & Voluck, a District Court judge in New Jersey has granted a defendant’s motion for summary judgment in a Fair Debt Collection Practices Act class-action lawsuit over the 1099C language in a collection letter, ruling that the disclosure used was not a false, deceptive, or misleading representation when attempting to collect on a debt.
DEBT COLLECTORS BANNED FROM INDUSTRY IN SETTLEMENT WITH FTC
- A debt collection company based in Atlanta and its owners have been permanently banned from the industry and will pay $266,000 out of a $3 million penalty under the terms of a settlement announced by the Federal Trade Commission, which had sued the company and its owners for threatening to have consumers arrested and imprisoned when trying to collect debts that the consumers did not actually owe.

- Navient yesterday announced it was transferring 5.6 million student loan accounts that it was servicing on behalf of the Department of Education to Maximus, another loan servicing company. Navient, which had decided already that it no longer wanted to continue servicing loans under the Next Generation Financial Services Environment program, or NextGen, instead will focus on other lines of business outside of student loans, including private lending and refinancing.
