APPEALS COURT UPHOLDS WIN FOR DEFENDANT IN FDCPA CASE
- The Court of Appeals for the Sixth Circuit yesterday overturned a summary judgment ruling in favor of a collector in a Fair Debt Collection Practices Act case, but only to remand the case back to the District Court with instructions to dismiss it instead, because the plaintiff lacked standing to bring his suit in the first place.
JUDGE GRANTS MSJ FOR DEFENDANT IN FDCPA CASE OVER CREDITOR ID IN LETTER
- A District Court judge in Florida has granted a defendant’s motion for summary judgment in a Fair Debt Collection Practices Act case, while also pointing out that the legal theory put forth by the plaintiff’s attorney has been “tartly” rejected by other courts and “does not improve by repetition.”
NY DFS SUPERINTENDENT ANNOUNCES RESIGNATION
- Linda Lacewell, the Superintendent of the New York Department of Financial Services, has announced her resignation and will leave office on August 24, the same day as departing Gov. Andrew Cuomo. Lacewell has been tied to the sexual harassment claims made against the governor, allegedly helping work to discredit one of the women who had stepped forward and accused Gov. Cuomo.

The analysis looked at individuals who are in income-driven repayment plans and voluntarily have made payments during the COVID-19 pandemic, revealing that 63% of those individuals owe more than what was originally borrowed.
