JUDGE AWARDS $62K IN EMOTIONAL DAMAGES TO PLAINTIFFS IN FDCPA CASE
- A District Court judge in Washington has awarded two plaintiffs more than $60,000 in emotional damages in a bench trial after suing a collector for allegedly violating the Fair Debt Collection Practices Act because the defendant attempted to collect more than what was owed and for making false and misleading statements when attempting to collect.
JUDGE DISMISSES HATE CRIME COUNT FROM TCPA COMPLAINT
- In a case that was first mentioned at TCPAWorld.com, a District Court judge in Illinois has partially granted a defendant’s motion to dismiss after it was sued for violating the Telephone Consumer Protection Act for allowing wrong-number calls from debt collectors because, for some reason, the plaintiff’s name was not on the account in question.

BILL INTRODUCED IN SENATE TO CREATE NEW DATA PRIVACY REGULATOR
- A proposed bill has been re-introduced in the Senate that would create a new consumer “watchdog” agency seeking to give individuals more control over their personal data. Called the “Data Protection Act of 2021,” the bill was introduced by Sen. Kirsten Gillibrand [D-N.Y.] with the intention of safeguarding consumer privacy and ensuring companies follow proper data protection policies and procedures.
