Collector Accused of Calling Plaintiff’s Parents, Leaving Messages Intended to ‘Trick’ Plaintiff Into Making Contact
- Voicemails. That old chestnut. They can be a problem for companies in the accounts receivable management industry. A collection operation is facing a lawsuit for allegedly violating the Fair Debt Collection Practices Act and South Carolina state law after it was accused of leaving voicemail messages for the plaintiff’s mother and father that disclosed the existence of a debt, for failing to identify itself as a debt collector, and for attempting to confirm a settlement agreement that the plaintiff allegedly had no knowledge of.

Judge Dismisses FDCPA Suit for Second Time Over Failed Promise to Pay Offer
- For the second time, a District Court judge in Tennessee has dismissed a Fair Debt Collection Practices Act lawsuit because the plaintiff lacked standing, ultimately ruling that the defendant’s decision not to honor a statement it made to the plaintiff that indicated a payment plan would be available in the future is not a violation of the statute.
