Collector Facing FDCPA Class Action for Including Creditor Name in ‘Large, Bold Capital Letters’ in Letter

  • A debt collector is facing a Fair Debt Collection Practices Act class-action lawsuit in the District Court for the Eastern District of New York because it sent the plaintiff a collection letter that included the name of the original creditor on the “letterhead” of the letter which allegedly made it appear as though the letter was coming from the creditor and not the defendant.

  • A District Court judge in Louisiana has granted class certification in a lawsuit involving alleged violations of the Fair Debt Collection Practices Act. The case centers on attempts to recover overpayments from a grant program established to aid homeowners affected by Hurricanes Katrina and Rita. This development follows a ruling from the Court of Appeals for the Fifth Circuit that overturned the lower court’s dismissal of the lawsuit.

  • With all the talk about medical debt this week as a result of the Consumer Financial Protection Bureau’s proposed medical debt credit reporting rule, it’s perhaps interesting to note that a majority of consumers feel forgiving medical debt is more important than forgiving student loan debt, according to the results of a new poll. Fifty-one percent of individuals believe it is very important or extremely important to forgive medical debt, compared with 39% who believe the same for student loan debt.
