Judge Denies MTD in FDCPA SOL Case

The Supreme Court of New Mexico has ruled that employees of a credit union engaged in the unauthorized practice of law by filing collection lawsuits to recover unpaid debts.

The background: The plaintiffs alleged that the defendant engaged in the unauthorized practice of law by having non-attorney employees file collection lawsuits against them in New Mexico state court. The plaintiffs argued that the defendant’s employees, who were not licensed attorneys, filed lawsuits and pursued judgments to recover unpaid debts, thereby violating New Mexico laws that limit the practice of law to licensed attorneys.

  • The district court initially dismissed the plaintiffs’ complaint, agreeing with the defendant that the actions taken by the credit union’s employees were permissible. However, the New Mexico Court of Appeals reversed this decision, and the Supreme Court ultimately upheld the appellate court’s decision, allowing the plaintiffs’ claims to proceed.

The ruling: The Supreme Court determined that the credit union’s actions constituted the unauthorized practice of law. The Court emphasized that under New Mexico law, only licensed attorneys may represent entities in court, including filing lawsuits and pursuing legal judgments. The Court found that the defendant’s employees, acting without legal licenses, improperly initiated legal proceedings, negotiated settlements, and obtained judgments against the plaintiffs.

  • The Court reaffirmed the principle that corporations and other entities must be represented by licensed attorneys when engaging in legal actions. The ruling specifically noted that exceptions for non-attorney representation are limited and do not apply in situations where the entity’s employees are actively pursuing legal claims, as was the case here.
  • The Court also highlighted that the unauthorized practice of law can have significant consequences, including the invalidation of judgments obtained improperly and potential liability for the entity involved.
  • The Court further explained that the intent of these restrictions is to protect the public and maintain the integrity of the legal system. By ensuring that only licensed attorneys handle legal matters, the Court aims to prevent unqualified individuals from engaging in complex legal activities that could harm consumers or lead to unjust outcomes.
